Section 125 CrPC: The Contradiction Between Maintenance and Imprisonment for Default

Mujhe lagta hai, woh Section 125 CrPC bahut hi confusion-fai hai. Woh kehta hai ki incase of non-payment of maintenance, husband can be imprisoned for up to one year. Lekin agar court mein case fail jaata hai, toh jail time ke liye FIR lagana padta hai. Kya yeh sach much hai? Kya Section 125 mein maintenance and imprisonment donon ke liye separate proceedings karni padti hain? Isse lagta hai ki court ko ek decision karni padti hai or fir phir jail mein bharne ke liye aur case fail hone ka risk lena padta hai. Ye ek big contradiction lagta hai. Kya koi expert is par feedback denega?

Yaar, I feel like Section 125 CrPC is a total paradox. On one hand, it provides a way for women to seek maintenance from their spouses who default on their responsibilities, which is a great step towards women's empowerment. But on the other hand, if the husband defaults on this order, he can be imprisoned, which kinda defeats the purpose of maintenance! Can't we find a more practical solution?
