Section 125 CrPC: Should Maintenance Allowance Be Linked to the Income of Both Spouses?

crpc_bnss mh_cet_law beginner discussion

Yeh toh ek baap ka question hai! As per Section 125 CrPC, maintenance allowance can be awarded to the wife, child or parents of a person who is unable to maintain himself or herself. But should this allowance be linked to the income of both spouses, even if they are divorced? I think it should, because let's be real, ek baap ka paisa do bap ko chahiye, right?

But what if the husband is already paying alimony to his ex-wife, and his income has decreased since then? Should the wife still get the same maintenance allowance when she doesn't even have to pay any other expenses? I don't think so.

So, what's your take, guys? Do you think maintenance allowance should be linked to the income of both spouses, or not? Let's discuss!

"Section 125 CrPC ke andar Maintenance Allowance ki payment karna court ka order hai, lekin iske under kya condition hai? Maintenance Allowance should definitely be linked to the income of both spouses, agar kisi ek spouse ki income high ho, to usi par reliance karna jayega. Yeh fair hoga, kyunki income se dependi hai maintenance ki quantum. Court ko lagta hai ki agar income jyada hai, to koi zaroorat nahi hui.
