Section 118 Evid Act - Hamesha Wrong, Kya Hoga?

evidence clat_pg beginner mcq_help

Mainne 2 saal pehle is sawal ka answer dhang se nahi liya tha. Ab fir se padhkar, dekha maine ki kahan galat tha. Question yeh hai:

A public document is relevant if it shows the handwriting of any person who is shown in the document to be alive at the date of the document.

Option A) True Option B) False Option C) Not relevant to the determination of the fact in issue Option D) Not relevant unless it relates to a matter in issue between the parties

Mainne 2 saal pehle option A ka election kiya tha, kyonki main sochta tha ki public document ke liye bina court kae affidavit ya witness ki zaroorat na ho. Lekin ab dekha to section 117-118 ka connection hai.

Section 118, sab log samjhe hain kya? Ye hamesha wrong nahin hai. Jab bhi victim ko apne statement ko record karne ka mauka milta hai, tab isse witness statement ke roop mein use kiya ja sakta hai. Iska matlab hai, jo bhi victim kuch bhi kaha, use ek witness ko kaha jata hai aur adhikarik record mein rakha jata hai.

Section 118 is indeed a tricky one. It says if someone denies something under oath, then that statement itself can be used against them, but only if there's other evidence to support it. But, agar aapko koi case ke liye evidence niyaad karna hai, toh iska use aisa karne se pahle kuch vichar karna hoga kya? Ismein koi faayda ya nuksaan hai?
