Sarpech v/s Section 174: The Investigating Officer's Catch

crpc_bnss mh_cet_law advanced analogy_post

You see, imagine the Investigating Officer (IO) as the coach of the cricket team. In a match, the umpire (Section 174) is like the match referee, who declares the match is being delayed due to bad light (suspicious death). Now, the IO (coach) has to take charge and decide what to do next. Sarpech is like the coach's power to call an audible, change the game plan. But, in this case, the IO needs permission from the magistrate or SSP (team management) to make that change, and that's what Section 174 is. So, before making any big moves, the IO needs to report to the higher authority (team management), get their approval, and then proceed with the investigation. Make sense?

Sarpech ban jaata hai jab koi shakyaat hoti hai, toh Section 174 koi investigation nahi hai, sirf mere pas kuch incident aaya tha, aur main uska police report likhaaunga. Investigation ke baad, agar koi shakyaat hai tab hi chargeframe kiya jaa sakta hai. Sarpech ki jaanch to pehle hi hui thi, toh Section 174 kya investigation ke liye hai?
