Right to Protest under Article 19(1)(a) comes with a cost
constitutional judiciary advanced news_to_lawTihar Jail's latest inmate, climate activist Disha Ravi, just got her bail denied. Her argument that she's being persecuted for exercising her constitutional right to freedom of speech, under Article 19(1)(a), doesn't quite cut it with the Delhi HC. This is what I mean by 'reasonable restrictions' in the name of public order and morality, Section 124A. Our courts have consistently held that Article 19 is not an absolute right, and you can't cry 'free speech' while inciting violence. It's a delicate balance between individual rights and public order, something our judiciary is expected to navigate.
