Revisiting the Vicarious Liability Doctrine: A 21st Century Dilemma
torts cuet_pg advanced reform_ideaRajesh_Kumar (posting from my 2:45am sleep-deprived brain) - I've been thinking about this and, honestly, the vicarious liability doctrine is way out of sync with modern times. In today's gig economy and with the rise of freelancers and online platforms, it's absurd that employers can still be held liable for their employees' actions. I mean, what about the Uber driver who gets sued for an accident? The company isn't directly responsible, but under the current doctrine, they can still be held liable. It's just not fair. And what about the liability for independent contractors? It's a murky area and leaves everyone vulnerable. Something's gotta give, kya? Can't we have some clear guidelines for this stuff? CUET PG Law friends, any thoughts on this?
