Section 125 of the Criminal Procedure Code, 1973, was enacted to provide for a fair provision of maintenance to destitute wives, children, and parents. However, the law has been misused and twisted over the years. The onus lies on the respondent to prove that the wife is not entitled to maintenance, which is an unfair burden. This provision needs a revamp as it fails to provide for the needs of the wife, especially in cases where she has been abandoned or separated by her husband.
