Resolving the Conundrum between Guardianship and Custody

family clat_pg beginner doubt

Yaar, samajh nahi aaya yaar! I'm having a tough time differentiating between guardianship and custody in Family Law. In every lecture and textbook, these terms keep getting used interchangeably, but something just doesn't seem right. Guardianship seems to be more about managing the affairs of a minor, while custody is about physical care and control. But isn't it the same thing? Kya difference hai? Please help, mujhe clarify karna hai. I'm all confused between these two. I was studying the case of Ashok Hurra v. Rupa Bibi (1988) where the court talked about best interests of the child in custody matters, but then I came across the Guardians and Wards Act, 1890, which has its own provisions for guardianship. I'm all mixed up, yaar!

Arre, don't worry, this is a complex issue, but with thorough understanding of Guardianship and Custody, we can tackle it. In India, Guardianship is a broader concept, it's about care and protection, whereas Custody is about actual physical control. We need to consider the welfare of the child, not just the rights of the parents. Let's discuss more, kya?
