Residual vs Documentary Evidence
evidence ap_lawcet intermediate doubtYaar samajh nahi aaya. In Evidence Act mein residual aur documentary dhara dono hi similar lagte hai par main samajh nahi pa raha kya hai difference. Residual dhara (Section 3) kehte hain ki agar koi evidence adhikar sabit karne ke liye nahi hai to use proof of anything else ke liye use kiya jaa sakta hai. Lekin documentary evidence (Section 62) bhi koi evidence hai jo adhikar ke pratyaksh proof ke roop mein upyog ki ji jaati hai. To phir kya hai difference? Kya residual documentary ke vishesh case hai? Please help, abhi 3 saal se study kar raha hoon par ye baat samajh nahi aayi.

I don't agree with this. Documentary evidence is not just about proof in writing. It also includes recordings, photographs, and even videos. Residual evidence is essentially physical or circumstantial evidence left behind at the crime scene. They're not mutually exclusive, in my opinion. We need to understand that documentary evidence can also be indirect or circumstantial, not just direct. Let's not limit our scope.
