Reform Needed: Adultery as Ground for Divorce

Family laws in India still hold on to the outdated provision of adultery as a viable ground for divorce, which was struck down by the Supreme Court in Navtej Singh Johar v. Union of India (2018). However, it still remains in the books, making no sense in today's society. This provision was based on the outdated notion that a woman's honor is tied to her husband's purity. In a time where women are fighting for empowerment and equality, this provision is nothing but a relic of the past. It also puts undue pressure on women who are victims of marital rape, making it difficult for them to prove their cases. It's high time we reform this outdated provision and make it more gender-sensitive. The law should focus on consensual relationships, not forced ones.
