Rebuttal to the "Exclusion of Admissions" myth
evidence clat_ug beginner agree_disagreeA common misconception about Section 24 of the Indian Evidence Act, 1872, is that statements made by a person in his/her admission are always inadmissible as evidence. Many students think kisi bhi admission ko evidence ke roop mein accept nahin kiya ja sakta hai (no admission can be accepted as evidence). But is this really true?
Section 24 only excludes statements made in admissions when they are 'made' in the presence of the public or the parties. Agar admission khuli tarah ya party ke samne diya gaya hai, toh uske liye Section 24 ka kaaryakarta nahin hai (if an admission is made openly or in the presence of parties, then Section 24 doesn't apply). This nuance is often lost on most students, leading to this myth. We need to understand the law carefully to ace CLAT UG.
