Rapist's Bail Plea Rejected: Victim's 'Loktantra' Upheld

criminal general beginner news_to_law

You won't believe what happened in a recent case in UP. The SC rejected the bail plea of a rapist convict, citing that the victim's 'right to life and personal liberty' (Article 21) takes precedence over the accused's 'right to bail' (Section 439 of the CrPC). Just like my papa said, this is a classic example of Section 354D of the IPC, which specifically deals with the punishment for causing physical or mental harm to a woman. The SC ruled that the victim's right to freedom from cruelty will not be compromised just because the accused has a family with a daughter. This is a huge win for the Loktantra, and a slap in the face for those who think they can get away with such heinous crimes!
