Quashing Orders vs. Contempt: Doon Mein Kya Fark Hai?

admin ailet intermediate comparison

In Administrative Law, AILET aspirants often find themselves confused between orders of quashing and contempt of court. To understand the difference, let's consider an example. In a case like L. Chandrakumar vs. Union of India (1997), the Supreme Court ordered a stay on the quashing of any orders, but the government went ahead and quashed the orders anyway.

Here, the government was held in contempt of court for disobeying the court's order. So, in simple terms, quashing is when the High Court cancels an administrative order due to procedural irregularities, while contempt of court occurs when the government disobeys a court order. So, doon mein kya fark hai? Quashing is about canceling a wrong order, while contempt is about punishing the government for disobeying the court.

Main samajta hoon ki yeh dono hain high court ke powers, lekin kuchh differences hain. Quashing orders direct high court ke powers se judi hain, jabki contempt proceedings woh cases hain jahain koi court ke orders ko kharaab karega ya apne pasand se rules ko break karega. Quashing direct court ki review power hai, jabki contempt court ka power hai koi person ko aapna command kare.

"Bhai, Quashing Orders aur Contempt mein koi ek- ek nahi hai, yeh dono alag cheezein hain. Quashing Orders judicial review ke madhyam se hota hai, jabki contempt case mein kisi judge ya court ke against kiya gaya hiyaaan ki goli lagta hai. Contempt mein adalat ka adalatsakt banaya jaata hai, jabki Quashing mein us case ko pura hi cancell kiya jata hai. Fikr mat kijiye.
