Punjab National Bank v. Amritlal Maheshwari: Where Section 19 is a total Khaak

contract clat_pg beginner reform_idea

This outdated law is still haunting us in 2025. Section 19 of the Indian Contract Act, 1872 says 'a contract by a minor is voidable at the option of the minor when he attains majority, but not at the option of the other party'. What's wrong with this, you ask? Simple - it's an outdated concept that doesn't account for modern-day realities. What if the minor is in a power imbalance situation? What if they're exploited by a family member or someone in authority? The provision assumes the minor can just wake up one day and magically know they were wronged. This doesn't account for systemic issues, trauma, or even basic human psychology. It's time for reform.
