Public V Private nuisance: Who Wins?

Yeh to sahi question hai! In CPC, public nuisance is discussed under Chapter 17, whereas private nuisance comes under Specific Relief Act. My argument hai: public nuisance should be dealt under CPC, not under CrPC. It's a civil issue, not a criminal offense. In Benajirbai K. Akolis v. State of Maharashtra (1969), the SC held that public nuisance is a civil wrong and a public duty to prevent it. So, why should it be under CrPC? It's not a 'crime', it's a 'nuisance'! Can't we have a standalone section dealing with public nuisance under CPC? It'll be easier to handle and prevent such issues. What say, guys? Agree or disagree?

Bhai, Public Nuisance v. Private Nuisance toh kafi confused ho jaate hain. Lekin Public Nuisance mein, government ko section 133 CrPC ka uddharan karna hoga. Agar private property mein public nuisance hui, toh owner ko damage ka compensation dene ka adhikar hoga. Neeche wala court mein, private owner ka hoga. Waise, ye sawal kaafi tricky haai, ismein kai factors ka vishleshan hota hai.
