Property Rights of a Co-Owner - Do They Extend to Exclusive Use?
property mh_cet_law intermediate discussionI think we all studied the case of Bhagat Ram v. Hukam Chand (1943 SCR 337) in our Property Law class. But how far does the concept of co-ownership go? Can a co-owner, who owns 1/4th share in a property, exclusively use the parking space in a commercial building? I believe, NO, they don't have that right under the Transfer of Property Act, 1882.
In my opinion, the concept of co-ownership is more about shared rights and liabilities rather than exclusive use. The co-owner's right to use a part of the property can be restricted or regulated by the other co-owners through a mutual agreement. But, can they unilaterally take exclusive possession of a part of the property? I think not!
