Property Law Dispute: Lease for Lesser Period

I'm having a spar with my friend over a question. We're both TPA buffs, but our heads are stuck on this one. We're in the middle of CLAT PG prep and I need your help, guys!

Question: If a lessor and lessee agree to a lease for a lesser period, which section applies? My friend says it's s. 106 of TPA, while I insist it's s. 57 of the Transfer of Property Act, 1882. I quote: "Where a contract of lease of immoveable property for a term not exceeding three years is made, it may be enforced by a simple contract, without writing." My friend counters with s. 106, which says "When a tenant holds over after the determination of his tenancy...". Who do you guys think is right?
