Pitfall of Privity
contract general advanced definition_doubtBro, I've seen many of you guys struggle with this one - 'Privity of Contract'. Our notes say it's about the relationship between contracting parties but it's so much more than that. Can anyone give me a real-life example of how privity works in contract law? Like, in a scenario where a third person is affected by a contract between two parties? Maybe some case law to back it up, bhai? I'm not looking for textbook answers, something that happens in real life.

Arre yaar, I disagree. Privity of contract ko sirf ek theory hi hai, lekin isse koi practical use nahi hai. Iska matlab yeh nahi hai ki privity of contract ka concept wrong hai, lekin humein iske limitations ko samajhna chahiye. Kuch cases mein privity of contract ka use ho sakta hai, jaise kuch exceptions mein, lekin isse har case mein application karne se pehle humein iske limitations ko dhyan mein rakhna hoga.
Bhai, main aapke saath nahin hoon. Privity ka falana hi nahi hai. Iss concept ka uddeshya to yeh hai ki ek contract ke samay yadi koi aur adhikaar hota hai, to uski prerana ya jansheeshta nahi ho sakti. Lekin isse kuchh chutkule bhi ho sakte hain, jaise ki privity of contract ke madhyam se adhikaar ko peechhe chorne ki sambhavana.
