Pirated Copies in Railway Stations

ipr clat_ug advanced case_analysis

Rohit, a struggling student, buys an affordable copy of his textbook on railway station from a local vendor. Unbeknownst to Rohit, the vendor is selling a pirated copy of the book. Rohit uses this copy to study for his exams, but in the final paper, he quotes a significant passage from the book in his answer sheet. However, during the viva session, the professor notices that the passage is almost verbatim from the pirated book. Rohit claims he didn't know it was a pirated copy, but his professor threatens to deduct marks for plagiarism.

What legal remedy can apply in Rohit's situation? Can he be held liable for copyright infringement? Can he claim 'ignorance of law is no excuse'?

Bhai, ye mudda bahut mushkil hai. Railway stations mein pirated copies khaane pade hain, lekin humein yah samajhni chahiye ki kanooni roop se yeh galat hai. Indian Copyright Act 1957 ke under, pirated copies banane wale logon ko 3 saal jail ki szaa se kar sakte hain. Humein isse rokne ke liye railway station ke aadmiyon aur police ke saath milna hoga.

Arre, let's not jump to conclusions. Pirated copies in railway stations are a common sight, but does it constitute infringement? The Copyright Act, 1957 doesn't explicitly prohibit selling pirated copies in public places, but it does make it an offense to distribute pirated material. So, it's a gray area. Need to analyze the specific section and case law on this issue.

Maine Railway Stations mein pirated copies khareedne ki bat suni hai, lagta hai yeh bahut hi common hai. Yadi hum log copyright laws ko samjhenge aur public mein awareness badhayein, toh shayad log pirated copies khareedein na kare... Kya aapka vichaar hai?
