Pati Patni Aur Panchayat

family judiciary advanced news_to_law

Do you guys remember the Patiala court's decision in a divorce case where the wife's name wasn't mentioned in the property papers? And she still got 75% share in the assets? Yeah, that's Section 19 of the Code of Civil Procedure (CPC) in action, folks. When a defendant's signature or initials are acknowledged on a document, but their name is missing, it's still considered valid for the purpose of proving service (khudkush) under Section 80 of the CPC. And in this case, the court held that the wife was still a beneficiary of the property due to the acknowledgment of her husband's signature. This highlights the importance of understanding the nuances of service and acknowledgment in family law cases.

Mujhe yeh show bahut problematic laga hai. Ek taraf, pati aur patni ki galtiyon ka ek sahi upayaikshan hai, lekin doosri taraf, panchayat ki role ko over-project kya hai. Kya yeh reality hai? Koi panchayat aise bharosa aur shakti se nahin karega jo apne parivaar ka faisla karega. Show mein isliye kai ghatein hai jo galti se dikhayi gayi hain.
