Noida Girl Hit by Auto: Liability on Driver or Owner?
torts clat_ug beginner discussionMaine suna hai ki CLAT ka exam khatam ho jaayega, lekin maine abhi bhi confusion hai ki kya main baarish mein ghuma raha hu. Tum sabhi ko yeh sawal puchne ke liye haasil karo, jahaan maine ek case dekha hai - Mohan Lal vs. Madan Lal, 1985.
Case yeh hai ki ek ladki ko Noida mein ek auto ne girti pahunchaya tha. Uske baap ne Madan Lal ke khilaf case daayla, jo ek rickshaw owner tha. Par court ne decision di ki owner ki property damage karne ki wajah se koi bhi financial liability nahin hai. Main samajh nahin sakta ki court ne ye decision kyun liya.

"Aap sabhi ko yeh pata hona chahiye ki Noida mein ek ladki ko auto se ghirne jana ek bahut hi dukhadh incident tha. Iss muddha mein driver ya owner ki liability kya hai, yeh ek samasya hai.
Additional info, guys! Section 139 of the MV Act says, owner's liability extends to 3 years. But, in this case, the girl was hit by auto while on foot, hence we'll have to consider hit-and-run provisions. The owner might still be liable under Section 139, but driver's negligence is primary concern here. We need more details on the accident. Was the auto stopped or did it flee the scene?
