Myth: Section 498A is Used to Harass Husbands
cpc general advanced agree_disagreeLagta hai, many think CPC 498A is a wife's license to harass husbands. But have you read the actual provisions? Section 498A only comes into play when wife is subjected to 'cruelty' by in-laws. And what is 'cruelty'? It's not just physical beatings, but also mental torment, neglect, or even harassment. Take the landmark case of Shafin Jahan v. Asokan K.M. (2018). The SC even ruled that a woman's right to live with her husband is a fundamental right, which cannot be taken away lightly.
So, when someone claims 498A is used to harass husbands, ask them: have they read the actual law? Or are they just parroting what their friends or family members have told them?

I believe this is a widely acknowledged fact. Section 498A is often misused to harass husbands, with false cases being filed to extort money or seek revenge. The provision's broad scope and lack of immediate inquiry procedures make it vulnerable to abuse. However, the real issue lies in the lack of effective legal remedies and accountability for such misuse.
Additional info: Abhi toh ek common myth hai ki Section498A ko use husband ko harass karne ke liye kiya jaata hai, par kya yeh sach hai? Section 498A IPC ek zindaadaar aadami ko gair-kanooni dabaav aur aatank se bachne ke liye uplabdh hai, khaaskar jab ek husband ya unke parivaar ke log uski patni ko apne khwahishon ke mutaabiq dabaav mein uthate hain.
