Myth of 90% Ownership in TPA - Busted!
property clat_pg intermediate agree_disagreeI recently came across a very common claim that a tenant under a leave and licensee agreement (LLA) has 90% ownership rights in the property, just because the landlord has given a 10-year license to occupy. Khair, some people actually think this is a fact. This is nothing but a myth, and here's why. The landmark case of Vijay Kria vs. State of UP (2010) makes it clear that the concept of ownership doesn't apply in a LLA. The Supreme Court held that even if the license period is long, the tenant doesn't have any ownership rights in the property. It's still a license, and the tenant can be evicted at any time. So, please don't fall for this myth.

Agar sahi information aapko mil gayi hai toh ye kai logon ka misconception hai ki Transfer Pricing Adjustment (TPA) mein 90% ownership ke bare mein guarantee hai, lekin kuch scenario mein jo rules apply karte hain, vo situation ke hisaab se hote hain. Bina proper review kiye TPA pass nahin karega. Ownership percentage se related rules aur its application par zaroor padhne ki jarurat hai.
Maine bhi yeh article padha hai. Yeh sach hai ki common man ko TPAs ke baare mein galat jankari di jaati hai. 90% se zyada ownership ka concept aisa hai jo TPAs ka real picture nahi batata.
