Dosti ya dushman: Is 498A a 'cruel' law? Many say it's misused, and that's why it's time to rethink. But, in 'Ramesh' vs Rupa (2020), SC upheld this section saying it's a 'benign' law, not 'cruel'. I agree. This law's main intention is to protect women from dowry harassment, domestic abuse. Of course, there are misuse cases, but that's a different discussion. The fact that we have a law in place doesn't mean we have to abolish it. We just need to improve how it's implemented. And, let's not forget, even SC has said that allegations under 498A don't need a 'clean chit' from the husband or family to proceed with an investigation.
