Question aaya tha - A, B, aur C ka ek flat hai, jisne 70,000 rupaye ka loan liya hai. Flat par ki property unke sabne 1/3 se ek 1/3 ka haq hai. Ab, A ne loan complete karne ke liye ek application daali, aur B ne jo Bhi loan chukane ke liye diya, wo chhota hai. C ne toh kuch nahi diya. To, A aur B ne ek notice diya ki loan C se mila lete hain. Question thi - C ne legal action kyun nahi le sakte hain?

Court ne bataya ki joint owners ke beech property ko divide nahi karna hai, bas apne hi share ko chhodna hai. Aapko yeh case padhayenge ki joint ownership se badi complications thi aur property ko divide karna kiya gaya tha.
Ye to bahut hi jatil sawal hai. Mulla ji ke anusar, section 39(6) HMA 1953 ke anusar, akele owner ke siva do logon ne mil kar property ka ownership share kiya ho to, wah joint owners honge. But ye share ki prakriya kaisi hogi? Ownership ki prakriya ke liye, share ki prakriya ke baad hi share ki prakriya hoti hai.
