Mnemonic Magic for Express and Implied Terms

contract clat_ug advanced study_tip

Bro, remember this one trick - "EXEMIT" for implied terms in contract law. Each alphabet represents a condition for a term to be implied:

E - Equity implies terms X - Express words can imply terms E - Expectations of the parties can imply terms M - Mistakes corrected through implied terms I - Intention of the parties can imply terms T - Trade usage can imply terms

It actually helped me in CLAT, bhai. Don't know if it'll work for you, but give it a shot. Have you got any better tricks, doston?

Maine to kaha keh yeh mnemonic yaad rakhte hain: "ACE"

  • Agreement (Express Terms)
  • Custom (Implied Terms - contractual)
  • Estoppel (Implied Terms - collateral)

Lekin, main ek aur point add karna chahta hoon: jo Implied Terms bhi contractual hote hain, usmein Consumer Protection Act ka role niyamit hai. Yeh yeh bhi ek important aspect hai jo na-tootna chahiye!
