Mitakshara vs Dayabhaga - Which Section 6?
contract general beginner concept_confusionDude, I'm totally lost in the Contract Law jungle. So, we were discussing Specific Performance in class and I'm still not clear about this one thing. Section 6 of the Specific Relief Act talks about when a court can refuse to grant Specific Performance. Apparently, it's all about the discretion of the court, but what throws me off is the mention of Section 14 of the Indian Contract Act. They say it's about the nature of the contract, but isn't that what we just learned about in the Contract Law syllabus? I mean, I know Mitakshara and Dayabhaga are like, totally different, but how do they apply here? I'm seeing a mitra (friend) of mine struggle with the same concept, and I'm starting to think I'm not alone in this confusion.
