Misunderstanding in Free Acceptance in Contract Law

Coaching institutes aur notes ke paas koi free acceptance nahi hota, lekin students isko bahut galati se maante hain. Free acceptance kya hai? Woh wo hai jab ek vyakti dusre ko kuchh pradaan karta hai, lekin uske kuchh sharton par bharosa karta hai ki uska offer aapko pasand ayega. Yeh offer nahi accept karna aur bina kisi valid reason ke offer par aana free acceptance hai.
Lekin yeh sawal hai kya aapko kabhi socha hai ki offer accept karne se pehle, offer dene wala apni conditions clear karta hai ya nahi.

Arre friend, main samajh raha hoon ki confusion hai kya? Free acceptance ka matlab hai ki when one party agrees to an offer, it means they're giving unconditional acceptance. But, if there are some pre-conditions, tohar acceptance 'free' nahin hoga. It's a subtle difference, but important distinction. If conditions are not fulfilled, it's not a free acceptance, and contract may not be formed.
"Yeh to kuch jyada complicated ho raha hai. Main akele ke liye sochta hoon, free acceptance ka matlab hai ki vartak (acceptor) contract ko free aur apni marzi se accept karta hai. Lekin yadi vartak ko contract mein koi shart ho aur uska poora palan nahi ho paya, to use free acceptance nahi kahunga. Isme samvedansheelta aur samjhaauta ka vishesh mahatav hota hai.
