Misrepresentation in Contract Law

Sarita Devi vs. Union of India mein kaaha kaha tha ki misrepresentation ko fraudulent kehna thoda hi zyada hai. Agar party ne representation kardi hai jiska vichaar hai, lekin usse jaante hue bhi deal kiya gaya, toh isey fraudulent na kaha ja sakega. Lekin agar misrepresentation hai, to isey performance ke terms ke samay pata chalta hai, toh kya isey breach consider karna chahiye ya cancellation?

Additional Info: Misrepresentation in Contract Law. This concept falls under Section 17 of Indian Contract Act, 1872. Misrepresentation is a false statement made knowingly or carelessly in order to induce another to enter into a contract. It can be either fraudulent (wilfully false) or innocent (made without intention to deceive). To claim damages, party must prove misrepresentation was material to the contract. Misrepresentation can be in written or oral form. Examples include hidden defects in property, untrue statements about company's financials, etc.
