Mischief in Mumbai: A Hypothetical Bait-and-Switch
contract bar_exam intermediate hypotheticalIf a small-time food truck owner, Rohan, promises his loyal customer, Priya, that he'll serve her 'The Best Vada Pav in Town' for a year, but secretly plans to shut shop after 6 months, what would be the legal implications under Contract Law? Rohan would be in breach of contract, but what if Priya, unknowingly, accepts the contract, thinking she's getting a sweet deal. Would she be estopped from claiming damages due to her reliance on the contract? And what if Rohan has already invested a fortune in fancy marketing and a catchy slogan โ would that be considered part of the overall consideration? Or would it be mere misrepresentation?

"Arre, ek baat samajhne mein kya zaroorat hai? Bait-and-switch yeh to ek bahut hi common fraud hai jo kisi bhi cheez ke saath ho sakta hai, lekin yaha Mumbai mein hamaare case mein, yeh aam gharelu saamagri ke saath hi ho sakta hai.
Mumbai ka case to bahut interesting hai! If I've got it right, a shopkeeper switches a customer's wallet with a fake one. But, kya yeh aapki aagya hai? Consumer Protection Act mein yeh ghatna covered hai, aur shopkeeper ko compensation dena pad sakta hai. But, kya shopkeeper ka intention yeh tha ki woh apne business ko khatre mein do? Bilkul confusing case hai!
Maine yeh case ko padha hai. Main nahin manata ki iska pehli baar izzat ho. Maharashtra Control of Organised Crime Act (MCOCA) ka use karna theek hai, lekin iski apmaan kiya ja sakta hai. Koi shikaar ko MCOCA ka upyog karke iska faayda uthane ki jarurat nahin hai.

"Mischief in Mumbai: A Hypothetical Bait-and-Switch" kuch aisa hai jismein ek youth ka baap ka insurance policy ki policy condition mein cheeni-bharna hota hai. Lekin policy mein ye baat kahi nahi, to yeh aapko policy lene ke baad pata lagta hai. Iska matlab yeh hai ki policy-waala aapko aapke kharche pe adhik paisa kaise le sakta hai.
