Koi bataye, main to abhi tak samajh nahi paaya. Jab employer ko Vicarious Liability ke under punishment milta hai, toh uss time uske employee ko punitive damages bhi kyun nahi mil sakte hain? Main ne ek question dekhya jismein likha tha ki employer ke khilaf compensation case mein, jismein employee ka misconduct shamil hai, to employee ko bhi punitive damages mil sakte hain. Lekin kya lagta hai kai to koi connection nahi hai.

Toh meri question yeh hai ki kya isse lagata hai ki employer ke khilaf punitive damages ki case ke liye, employee ko individual lawsuit nahi chahiye?

Yeh topic bahut interesting hai. Vicarious Liability aur Punitive Damages dono hi ek dusre se judhe hue hain. Jab koi employer apne employee ke liye karyavaahak ke roop mein karya karta hai, to hum usse liability ke liye jaante hain. Lekin agar employee ko koi khatra pahunchta hai, to employer ko punitive damages bhi dena padh sakta hai.
