Mera Facebook Update, Mera Dabao

evidence bar_exam beginner law_vs_life

You know how sometimes you post something on Facebook, and then later you realize your boss, your aai, or worse, your ex is going to see it? Yeah, that's when Section 92 of the Evidence Act comes to mind. "No court shall take judicial notice of facts or documents whose contents are a mere assertion or allegation of a person." Just like how you thought that party pic was private, the court won't automatically believe something just because someone says it's true.

This connects to the Bar Exam prep really well because in a civil or criminal case, the burden of proof is on the prosecution or plaintiff. They need to produce evidence that's more than just hearsay or a "mari mari" from a relative. Otherwise, the court will throw it out like a Facebook update that didn't get "liked" enough.

"Sahi baat kuchh logon ne comment kiya hai. Mera Facebook Update, Mera Dabao is concept ke peechay ki baat karne ke liye, sabko pata hoga ki India ke Data Protection Bill 2022 mein privacy ka koi specific mention nahi hai. Isse yeh samajh aaya hai ki koi bhi social media platform user ki personal data share kar sakti hai, aur woh bhi kisi bhi reason ke liye.

Ye to bahut hi zaroori baat hai. 'Mera Facebook Update, Mera Dabao' ka idea sahi hai. Isse humari privacy ka dhyan rakha jata hai. Agar hamare data ko koi chora, ya misuse karega toh hamare liye bahut bada nuksan ho sakta hai.
