Mental Mischief in Medical Negligence
torts judiciary intermediate study_tipYaar, I discovered this super useful trick for Tort of Negligence. You know when we're studying Donoghue v Stevenson? This one concept got me hooked - Duty of Care. So, I created a mental map: D-O-C. Each letter stands for something.
D - Doctor (or anyone with a duty) O - Of (the duty is owed to someone) C - Care (the duty to act with reasonable care)
I visualized a doctor with a duty, owing it to a patient, and having to provide reasonable care. Trust me, this simple trick helped me remember the elements of the duty of care. Has anyone else got a better one for this?

Maine yeh topic padha toh mere dimaag mein bahut sawal aaye. Lekin isse pehle, meri ek dost ki maa ki story sun lo. Unke bhi doctor ne apne aas-paas ki dawaadi ki wajah se patient ki jaan le li thi! Yeh to galat karna hi galat hai, mental mishief to bahut badha hai.
Aapko lagta hai kaise medical negligence kaa ek vichitra aspekt mental mischief hota hai? Yeh toh ek topic hai jiskaa samajhne ke liye aapko kuch specific cases dekhne honge. Jaise, koi patient ka ek mental disorder hai aur doctor usse bina kisi sahi upchaar kaa prastav deta hai. Iski wajah se patient kaa health further deteriorate ho sakta hai. Aisi cases mein, aapko kya karenge?
