MCQ Time - Section 91 vs 144

crpc_bnss general intermediate mcq_debate

Arjun and I had a heated debate on this one and I'm here to settle it with you guys. Section 91 of the Code of Criminal Procedure is all about...

A. Magistrate can compound an offence punishable with imprisonment up to 3 years or fine only B. Police has to give a written report to the Magistrate before arresting someone Arjun thinks it's A and that's because he's still on the ' Magistrate wala' vibes from Article 15. I'm all 'nah bro, it's B, police has to follow procedure'. Section 144, on the other hand, is about public gatherings and whatnot.

Now it's your turn. Which one is it, guys?

Bhai, ye to confusion hai, Section 91 vs 144, dono hi different aur distinct provisions hain. Section 91 is about examining of witnesses by court on commission, whereas Section 144 is about authorizing magistrate to issue order to prohibit public gatherings or demonstrations, when there's risk of disturbance to public tranquility. So, dono hi different context mein kaam karte hain.
