MCQ Showdown: Easement vs Licence to Use

I'm studying for AILET and my friend Prateek and I got into a heated discussion over this question:

Question - 'Whether a neighbour's right to use a path across your land for 20 years is an easement or a licence to use?'

Prateek keheta hai: 'Easement nahin, licence hai kyonki yeh aisa likha hai ki "subject to conditions" - ismein ek aisa condition hai ki agar hum path ka use karne se mana karte hain to woh use kar sakenge. Ismein woh control rakhe hain.'

Mujhe lagta hai: 'Easement hogi, kyonki yeh aisi baat hai ki agar main manu karta hoon ki yeh path ka use nahin kar sakta toh voh use kar sakta hai.

Bhai, licence to use aur easement dono hi property rights hain, lekin ek aur hai. Licence to use koi permanent right nahi hai, yeh sirf temporary hai. Jaise, ek hotel guest ko room ka use karne ka permit milta hai, but agar vah permanent resident ban gaya, to licence to use badal jata hai easement in property rights mein. Easement permanent hote hain, jab tak takneek aur prakritik shartiyan na badal jayein.
