I and my friend Rohan had a debate on this contract law question for DU LLB Entrance. I'll share both our arguments and you guys settle it.

Question: A, a businessman, agrees to buy B's car for โ‚น5 lakhs. Next day, A sees the car's market value has dropped to โ‚น4 lakhs. A refuses to pay the agreed price. Can B sue A for specific performance?

Rohan says: "Absolutely not. This is a case of unilateral mistake (Mistake of Fact, Sec 25 of Indian Contract Act). A can avoid the contract."

I say: "No way! This is an unilateral mistake, but A is not trying to escape liability. A is trying to take advantage of the mistake and get a better deal. This should be considered a case of 'unfair advantage' and B can indeed sue A for specific performance."

MCQ Ka Vishwas Nahin

MCQ (Multiple Choice Questions) ka yeh topic abhi bhi jyada vikrit hain. Logon ko lagta hai ki yeh questions aasan hain lekin vaktiyun ke saath, logon ko pata hi nahin chalta ki kya khasaam kaun khaata hai. Yeh questions bahut bada dhokha bante hain.
