In Section 300 IPC, the Exception 4 states, "Nothing is an offence which is done by a person who at the time of doing it, by reason of unsoundness of mind, is incapable of knowing the nature of the act, or that he is doing what is either wrong or contrary to law."
Question: Can a minor (below 18 years) be held liable for murder under Section 300 IPC?
Argument 1 (friend): Haan, bhai, they can be. The exception only talks about unsoundness of mind, not age. If a 14-year-old can understand the nature of the act and knows it's wrong, why not? It's not about being mature or not, but about the legal age of liability.
