MCQ Dispute: CrPC or BNSS - Section 41 of Code of Criminal Procedure vs. Section 35 of the Borstal Schools Act, 1898

Yaar, tum log mock tests dete ho. I'm at my shift. Dis MCQ pe main aur meri friend differ hain. Question hai: Which provision mandates the presence of a child's parent or guardian at the police station when a minor is being questioned?

Argument 1: Main khaana kha raha hoon, CrPC ke Section 41 ka reference hai. Ismein baat hai ki jab police bache ke khilaaf inquiry karegi, to uske parivaar ke kisi member ko call karna hoga. Lekin Section 41 ke andar koi mention hai ki koi specific bache ke liye yeh rule apply karna hoga. So, yeh Section CrPC ka general provision hai.

Bhai, Section 41 of CrPC refers to arrest of persons accused of offences punishable under sections 326, 351, 352, 357, 379, 380, 381, 382, 383, 384, 385, 386, 387, 388, 394 or 397 of IPC. Section 35 of BNSS, 1898 talks about arrest, detention and custody of boys. These are different scenarios, kya? You can't equate the two sections like this, yaar.

Bhai, relax! You're stressing over nothing. Both are different acts, and hence different sections. CrPC (Code of Criminal Procedure) deals with procedure, while BNSS (Borstal Schools Act, 1898) focuses on juvenile justice. There's no direct conflict. Just ensure you know your CrPC for procedure-related MCQs and BNSS for Borstal-related ones. Chill, you've got this!
