Mamlatdar's Powers vs. Collector's Orders: Kahaan Se Kahaan Tak

property judiciary advanced doubt

Yaar samajh nahi aaya, koi to help karega. Main Judicial Services ki taiyari karte huye, Property Law/Tarhapatra Adhiniyam mein do concepts khada karte huye dekha, jo kuchh hi saamne aaye hai - Mamlatdar ki shaktiyan aur Collector ki paripatraein. Dono mein hi land acquisition, compensation, aur zameen ki transfer ki baat hoti hai, lekin koi khaan paan toh nahi.

Mamlatdar ke hisaab se, unki zameen ki transfer par Collector ki kehni paripatra ko ek 'order' kehte hain, jiska prabandhan 32(3) TPA mein liya gaya hai.

Aap logon ne to bahut accha sawal uthaya hai. Bas ye clarify karna hai ki Mamlatdar ko Collector ki order ke khilaaf action le sakne ki koi nahi power hai. Section 195A, MPRA 1964 ka matlab yehi hai ki Collector ka order apna hona chahiye, Mamlatdar ka nahi.

Bhai, don't worry, we'll break it down together. Section 129 of MPMLA clearly gives Mamlatdar powers parallel to Collector's orders. But, Collector's orders can override Mamlatdar's decisions under Section 123. It's about application karein, context and facts of the case. Need to read judgments of Gujarat High Court for clarity - 'Kamani Sugar vs Gujarat' is a good starting point.
