I couldn't believe my eyes when I saw Messi's trademark lawsuit against a small Indian firm. Essentially, Messi claimed that the firm's use of his image on a football jersey infringed his trademark rights. Now, this is a classic case of dilution of trademark goodwill under Section 29(4) of the TradeMarks Act, 1999. You see, when a mark is used in a way that tends to blur the distinctiveness of the original mark, it's considered trademark dilution. In this case, Messi's image on the jersey might just dilute the distinctiveness of his trademark, making it harder for consumers to associate that image with him exclusively. This is exactly what the legislators had in mind when they introduced Section 29(4).
