Kya Baap Hai Torts Ka!

torts clat_pg beginner internship_learn

Ye sab kuch aapke textbook mein nahin likha hoga, lekin mujhe ek internship ke dauran padha. Maine dekha ki Torts mein negligence ka concept bahut hi important hai, but sabse zaroori cheez yeh hai ki negligence ka burden shuru karne ke liye, "duty of care" ka presence zaroori hai. Iske madhyam se, court ko decide karna hota hai ki kya victim ko yeh samajh aayega ki aapke karne se kya nuksan ho sakta hai. Abhi CLAT PG aur AILET PG mein koi bhi case reference likho, to is concept ko padha ja raha hai, lekin fir bhi yeh ye pata nahi lagta ki uske baad kya hota hai.

Arre! Yeh toh torts ka bap to sirf Lord Coke hai, nahi baap! Torts ka father to William Blackstone hai, jo ke sirf ek English jurist the. Unhone ke "Commentaries on the Laws of England" me torts ki concept ko samjha. To, kya baap hai? Waisi baat hai, Blackstone toh Blackstone, Coke toh Coke.

Bhai, Torts ka matlab yah hai ki jab koi aadmi doosre ke actions se nuksan pata lagta hai, toh wo action videsh sambandhit ho sakta hai. Jaise ki, aapne ghar mein khane ka oil spill kiya aur uss se next door ke ghar ki furniture spoil ho gayi. Yah hamesha unke liability par depend karta hai. So, Baap Torts ka nahin hai, par yeh ek bahut majboot branch hai.
