Bhai, I beg to differ. Corporate Governance already has several statutory provisions under the Companies Act. Mandatory law might be overkill. Over-regulation can stifle innovation and entrepreneurship. Kotak Mahindra example was a one-off incident, the SC verdict in fact upheld the concept of Corporate Governance, it's not a law and order situation. We must strike a balance between regulation and entrepreneurial freedom.
Main toh think yeh nahi hai ki corporate governance ko mandatory statutory law banna chahiye. Yeh sab unki internal policies hai. Bahot saari companies jaise Kotak Mahindra, HDFC already apne internal policies mein corporate governance ki guidelines follow karte hai. Abhi yeh aisi cheezein laws ke zariye nahi honi chaahiye. Isme bahot saari procedural complexities aayengi.
Mujhe lagta hai ki Corporate Governance ki zaroorat hai. Kotak Mahindra case ne is ko saabit kiya hai. Agar yeh kanoon mandatori hota hai, toh companyon ko achhi tarah se operate karna padega. Shareholders ki suraksha aur transparency badh jayegi. Yeh desh ki future ko surakshit banana jaana chahiye.
