Kharar Promoters Association v. State of Punjab
property judiciary beginner mcq_debateMe and my friend are at loggerheads over this. Question: Under the Land Reforms Act, 1953 (Punjab), whether an intermediary's right to receive share of profits is a right in land?
My friend says no, it's not a right in land, citing Section 2(7) of PLRA, 1960, which defines 'landowner' to exclude an intermediary. I say yes, because the intermediary's right to profits is a bundle of rights that coexist with those of the landowner, and is therefore a right in land (see Mavoor Tank Ributkar v. State of Mysore, AIR 1934 PC 221).
What do you folks say?
