Jurisprudence Law: Focusing Too Much on Theory, Not Enough on Practical Relevance.
jurisprudence general advanced hot_takeI think our law schools focus too much on the theoretical aspects of jurisprudence and not enough on how it's actually applied in real-life cases. We get caught up in debating the finer points of natural law versus positivism, without considering how these concepts impact access to justice. Ye sab theory hai, but do you know how many people lose cases just because they don't know this section exists? I'm not saying we should ditch the theory altogether, but we should make it more relevant to our context. For example, studying the Indian Contract Act and how it's been used in landmark cases like P. Ramachandra Rao v. Dwaraka Das and Co. [1962] 3 SCR 864. This way, students can see the practical application of jurisprudential concepts, not just memorize them.
Arre bhai, I toh feel ki jurisprudence pe focus theek hai, lekin ye sab theories mein baithkar rehte hain. Sabko pata hai ki law practice mein practical kya hota hai. Hum students ko practical training aur moot court sessions se judna chahiye. Theory important hai, lekin abhi practical mein expertise hona bhi zaroori hai. Naya Bharat banaate hain, to naya Bharat ka law student banne ke liye kuch naya karna padega!
