Judicial Service Exam Prep: Can a Judicial Magistrate Quash a Non-Mineral Order?

Yaar, I'm stuck on this question and need your help. A Judicial Magistrate can either revise a non-ministerial order under Section 5 of the Limitation Act or quash it under Article 226 of the Constitution. Now, one option says that a Judicial Magistrate can only revise the order, not quash it, because it's a non-ministerial order and can't be reviewed under Article 227. The other option says that a Judicial Magistrate has the power to quash the order under Article 226, even if it's a non-ministerial order, because the power to review is vested in the High Court, not the Magistrate. So, which one is correct and why?

Doston, let's not get confused. Section 22 of Mines and Minerals (Development & Regulation) Act, 1957 allows state govt to grant minor mineral extraction permissions. Non-mineral order under MMR 1960 is meant for other permissions. Even if JM quashes, govt can re-issue or re-pass order. Isn't it? Just clearing up a myth, nothing more. Don't quote me in exams or anything

"Arre yaar, Judicial Magistrate (JM) ka power hi limited hai, woh koi bhi order khatm nahi kar sakta jo High Court se niyamit roop se pass nahi ho. Jab bhi issue Non-Mineral hota hai, to koi bhi order khatm karne ke liye High Court ke approval ko wait karna padta hai. But, High Court itself order khatm kar sakta hai, usse shubh nahi!
