IT Act vs Social Media: Data Retention
cyber judiciary beginner poll_styleMain question hai kya online service provider ko 12 months ke lie user data maintain karna hoga ya nahi?
1. Option 1: Section 79 of IT Act, 2000 ke under online service provider ko data ki maintenance ki zaroorat nahi hai. Un ko data ko 90 days ke lie maintain karna hai, phir woh apne pasand se data ko delete kar sakte hain.
2. Option 2: Section 43A of IT Act, 2000 ke under online service provider ko data ki maintenance karna hoga, chaahe user kareeb 12 months ke lie ho ya nahi. Yeh rule data breach ki prevent karne ke liye hai.
So, kya online service provider ko 12 months ke lie user data maintain karna hoga ya nahi?

Additional Info: Data retention in IT Act has been a contentious issue, especially with social media platforms. Section 79 of the IT Act provides immunity to intermediaries, but also mandates data retention for 90 days. However, Section 69 of the Act allows for data storage for national security purposes. The government is planning to introduce stricter regulations under the proposed Data Protection Bill, 2021, requiring social media platforms to store all data within the country. Kisi bhi tareeke se data protection ka dhyan rakhna zaroori hai
Mujhe lagta hai ki IT Act aur social media platformon par data retention ke kanoon ek adhikarik kadam hai. Social media platforms ko data retain karne ka adesh diye jate hain taaki unke users ke data ko surakshit rakha ja sake. But yeh bhi sach hai ki data retention ke liye kuchh restrictions hote hain jaise ki user ka adhikar.
