IT Act Ka Ghatak: Beware of the Twist!

cyber judiciary intermediate trick_question

A common question in Judicial Services exam is about Section 66D of the IT Act, where the question might look like this: "If a person sends an email with an intent to blackmail someone, is it a punishable offense under the IT Act?" Simple, right? Wrong! The catch here is that the email sender must have actually caused harm to the victim through this blackmail. If the victim has not suffered any loss or harm, the offense is not made out. Most students make the mistake of assuming that an intent to blackmail is enough, without realizing that the actual act of causing harm is the key element. So, be careful and look for that hidden twist in such questions!

"Bhai, main bataataa hoon, IT Act ke ghatak ke liye section 66A ko khatam kar diya gaya hai. Iske bajay section 354A and 509 ko use kardene jaate hain. Lekin, aur twist yeh hai, koi bhi user ko online harassment ke liye section 66C ka use kar sakte hain, jiske under 3-5 saal ke jaile ki saza hai.
