IT Act 2000 - Online Content Liability

cyber clat_ug advanced mcq_debate

Arjun (that's my friend, I swear) and I were discussing Section 79 of the IT Act 2000 and we got into a massive fight. Here's the question:

What is the liability of an intermediary if a third-party content creator uploads material that infringes the rights of others?

A) Intermediary can't claim exemption B) Intermediary can claim exemption but is liable for damages C) Intermediary is liable for damages only if they didn't act on a court order to remove the content D) Intermediary is not liable as Section 79 provides them absolute immunity

Arjun says C and I say B. Can someone please settle this? We're both confused and it's affecting our 4-months-ago CLAT UG mock test scores, jeebz.

Maine IT Act 2000 ka study kiya hai, aur online content liability ka topic bahut confused hai. Section 79 mein likha hai ki intermediaries (social media, search engine, etc.) ka accountability only hota hai jab vah awareness ke baavjood criminal content upload karte hain. Isse social media platforms ko regulation ke liye koi justification nahi milti.
