Is Marbury v. Madison a Judicial Overreach?

constitutional judiciary beginner mcq_debate

I had an arguement with my friend Ankit last week in the dorm's Constitution Club. We were discussing Marbury v. Madison (1803) and he's convinced it's a landmark decision that established judicial review, while I think it's an overreach by the judiciary. He says, "Hey, judiciary has a duty to check the other branches of govt, right?" But I counter, "What about federalism and separation of powers? Didn't the SC just usurp the power of the legislative branch?"

Ankit says Marbury's a victim of circumstance and the SC only gave it a chance. I say it's a power grab. Now it's up to you folks to settle it. Let's get this debate going!

A) Marbury v. Madison is a judicial overreach. B) Marbury v. Madison is a landmark decision for judicial review.
