Is Article 32 of Constitution can be invoked by a public spirited citizen?

Kabhi kabhi toh lagta hai ki ye Constitution wala funda sirf Court ke liye hi hai. Lekin kya hai yeh, Article 32 ke under hum public spirited citizen bhi habe? Kya public spirited citizen ko bhi habe Habeas Corpus ki facility?

Maine suna hai ki Delhi Judicial Services case mein SC ne kaha tha ki Article 32 only those can invoke who have a personal stake in the matter. But kya yeh rule ab bhi valid hai? Aur agar valid hai to yeh kisliye? Lagta hai yeh to public interest litigation ki baat hai, jisey SC ne bahut hi support kiya hai. Kya yeh dono contradictory hain?

Constitution ke 32nd Article mein yeh bataya gaya hai ki koi bhi citizen Supreme Court ki court mein jhuk sakti hai. Public spirited citizen toh court mein jhuk raha hai, toh kya zaroorat hai court khud apne aap mein? Iska matlab hai ki haan, public spirited citizen Article 32 invoke kar sakte hain.

Article 32 - ye toh public spirit se zyada hai! But seriously, yes, a public spirited citizen can move to the SC under Article 32 for 'enforcement of rights' which includes fundamental rights. However, it's essential to note that the SC has limited scope for 'advisory' jurisdiction & mostly looks into individual rights cases.

Article 32 of our Constitution, yeh bahut hi aam sawal hai. Mera man hai ki yes, ek nirbhar shakti shahari (litigant in person) visheshat aapne aap ko Article 32 ki shakti se peechha kar sakta hai. Inke paas koi vishesh pratinidhi nahi hona chaahiye, yeh toh kanooni adhikaron ka mukhya kaarak hai.
